Terms of Service

Welcome to Dracxi Hosting ("we", "us", "our"), a New Zealand registered business. By purchasing, accessing, or using any service provided by Dracxi Hosting, you agree to be bound by these Terms of Service.
If you do not agree with these terms, you must not use our services.
These terms do not limit or exclude any rights you may have under the Consumer Guarantees Act 1993 or Fair Trading Act 1986.
1. Services
Dracxi Hosting provides game server hosting, virtual servers, and related infrastructure services. All services are provided on a best-effort basis unless otherwise stated in a Service Level Agreement (SLA).
We reserve the right to modify, suspend, or discontinue services with reasonable notice where possible.
2. Account Responsibility
You are responsible for:
- Maintaining the security of your account credentials
- All activity that occurs under your account
- Ensuring your use of services complies with applicable laws
Dracxi Hosting is not responsible for compromises caused by weak passwords, leaked credentials, or user misconfiguration.
3. Acceptable Use
You may not use our services to:
- Host illegal content or conduct activities prohibited under New Zealand law (including but not limited to the Crimes Act 1961, Harmful Digital Communications Act 2015, or Films, Videos, and Publications Classification Act 1993)
- Distribute malware, DDoS tools, or engage in network abuse
- Attempt unauthorised access to systems or data
- Resell services without written permission
Violation of these rules may result in immediate suspension or termination. Refund eligibility in such cases is subject to the Consumer Guarantees Act.
4. Payments & Billing
- All prices are charged in NZD
- Services are billed in advance unless otherwise agreed
- Failure to pay may result in suspension or termination
- We reserve the right to adjust pricing with notice for renewals
5. Data & Backups
While we may provide automated backups, you are responsible for your own data.
Dracxi Hosting is not liable for data loss due to user error, software issues, or force majeure events.
6. Limitation of Liability
Nothing in these terms limits or excludes any liability that cannot be limited or excluded under New Zealand law, including the Consumer Guarantees Act 1993.
Subject to the above, and to the fullest extent permitted by law, Dracxi Hosting is not liable for:
- Loss of profits or revenue
- Loss of data (you are responsible for maintaining your own backups)
- Indirect or consequential damages
Where liability cannot be excluded, our total liability shall not exceed the amount paid for the affected service in the preceding 12-month period.
7. Termination
We may suspend or terminate services for breach of these terms.
You may cancel your services at any time via the billing panel.
8. Changes to Terms
We may update these terms from time to time. Significant changes will be notified via email where possible. Continued use of services after notification constitutes acceptance of the updated terms.
9. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of New Zealand.
Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the New Zealand courts.
